TESNEY AI Privacy Policy
TESNEY. (hereinafter referred to as "the Company", "TESNEY AI", "we", or "us") respects your privacy and is committed to keeping all information obtained from or about you secure. This Privacy Policy describes our practices regarding the data we collect from or about you when you use our website and services (collectively, the "Services"). We use your data to provide and improve the Services. By using the Services, you agree to the collection, use, disclosure, and procedures set forth in this policy. In addition to this policy, use of the Services is subject to our Terms of Service, and any capitalized terms not defined in this policy have the meanings set forth in the Terms of Service.

We may collect various personal data from or about you or your device from various sources as described below. The types of data we collect depend on how you use the Services. The Services include optional features, and if you choose to use them, we may need to collect optional data to provide that feature. You will be appropriately notified of such collection.
Failure to provide personal data upon request may result in you being unable to use the Services if that personal data is necessary to provide the Services or if we are legally required to collect it.
A. Personal Data You Provide
(1) Registration and Contact Information. When using the Services, you may provide certain data to create a platform account, such as email address, username, age, etc. A platform account is provided when you first log in to TESNEY AI via email verification. You can access the platform services by logging in with your account.
(2) User Content. We process content and personal data that you upload, create, or access through the platform. This includes photos, images, and videos you upload, create, or view on the platform, comments you write, and other actions (including likes, follows, etc.) (collectively, "User Content"). When you create User Content, you can upload or import it to the platform before saving or posting your User Content (also known as pre-upload).
When you use the Services, we may collect information about images and audio that are part of your User Content. This includes identifying objects and scenes that appear, the presence and location of faces and body features and attributes in images, characteristics of audio, text of words spoken in User Content, etc., for enabling special video effects, content moderation, and other non-personally identifiable tasks.
(3) Financial Information. When using the Services, you may provide certain data such as virtual items, voucher codes, card account numbers, third-party payment details, transaction/transfer/order/withdrawal/reward/tip records, and/or other ID information necessary for user/account identification (with your consent). This is to ensure transaction security and TESNEYete service payments.
(4) Communication Information: When you communicate with us, we collect your email, contact information, and the content of messages sent.
(5) Other data inferred from or related to the above information. When using the Services, you may provide certain data such as metadata accompanying user-generated content, audiovisual clip segmentation, annotation, frame or text extraction, object and image recognition symbolization, aggregate classification tagging, and other non-personally identifiable information inferred from data you provide or we collect in relation to your use across TESNEY AI. This information may be collected locally to enable special video effects and is only used to provide the mentioned features. We do not collect, share, or store facial data, and the above information cannot be used to identify individuals. We do not use the information for other purposes or upload, share, or store data.
B. Personal Data We Collect Automatically
(1) Network and Device Information. When you use the Services, we may automatically collect personal data such as user ID, password, token, digital certificate, IP address, device ID or characteristics, cookies, advertising identifiers, WiFi/WLAN Bluetooth, mobile network information, app and file names (with your consent).
(2) Network Browsing Data. When using the Services, we may automatically collect personal data such as choices you make when using or interacting with TESNEY AI, communities and/or advertisements (if available), account settings, follow history, followers, likes or challenges, surveys, contests or other platform activities provided through TESNEY AI, account social network contact/friend list (with your consent), operating system type and version of your computer or mobile device, manufacturer and model, browser type, screen resolution, RAM and disk size, CPU usage, language settings for service provision, etc.
(3) Online Activity Data. When using the Services, we may automatically collect personal data such as pages or screens viewed, time spent on pages or screens, browsing history, navigation path between pages or screens, information about your activity on a page or screen, access times and duration, whether you opened marketing emails or clicked links within them, etc.
(4) Cookies: We use cookies to operate and manage the Services and improve your experience. "Cookies" are pieces of information sent by the website you visit to your browser. You can set your browser to accept or reject all cookies, or to notify you when a cookie is offered so you can decide whether to accept it each time. However, rejecting cookies may in some cases make it impossible to use the website or negatively affect the display or function of the website or certain areas or features.
(5) Analytics: We may use various online analytics products that use cookies to help us analyze how users use the Services and improve their experience when using the Services.
The categories and scope of data we collect about you may vary from time to time depending on your choices and interactions with TESNEY AI, and the country or region where you use TESNEY AI. You will be appropriately notified of such changes.
If the feature is provided, you may choose to browse certain content on the platform without logging in or registering, in which case we may still collect certain data such as the content you browsed, your interactions with the platform, and related device information such as device ID, WiFi information, IP address.
C. Data Combination
You agree that we may combine personal data we receive from and about you, including personal data you provide and personal data we automatically collect, with personal data we may receive from third parties to help personalize our communications with you and improve our services and products. If you do not agree to this section, do not use the Services.
Providing certain personal data to us may be a legal or contractual requirement or a requirement necessary to enter into a specific contract or an obligation you may have to provide us with that data. In such cases, we will separately notify you and explain the possible consequences of not providing such personal data to us. In all other cases, the provision of requested personal data is optional and may not affect normal use of the Services but may affect your ability to use certain services where the information is needed for that purpose.
How We Use Your Data
We may use your data for various purposes related to operating our business and providing TESNEY AI, including:
(1) Identification and Authentication: We use your data to verify your identity or eligibility when you access and use the Services, receive rewards or prizes, or otherwise engage with us, and to protect the security of your data. In some cases, we use your data to verify your age to provide certain services or to verify your identity to fulfill requests related to your data.
(2) Service Provision: We process your data to provide the services you request, to answer your questions, or to contact you about changes to TESNEY AI and the platform. This may include managing the content ecosystem across TESNEY AI, facilitating third-party partnerships or integrations across TESNEY AI, monitoring and testing TESNEY AI, troubleshooting, or enabling you and other users to connect with each other.
(3) Payment Processing: We may use your data for billing and payment processing purposes or to distribute prizes to you. This may include enabling payments through third-party payment systems.
(4) Service and Algorithm Improvement, Development, and Research: We examine and analyze usage information and statistics to maintain and improve TESNEY AI and its algorithms. We may also use your data to support customer service and user feedback, conduct surveys or research, and develop new products and services.
(5) Communication: Communications may include, for example, providing information about our products and services, notifying you of changes to the Terms of Service, service updates, user information reports for minor users, or responding to your questions, comments, or requests.
(6) Content Moderation: We may process your data to identify users, audio, and video in content you create or upload to TESNEY AI to detect inappropriate content.
(7) Marketing, Advertising, and Sales: We may use your data to create profiles about you, analyze and understand your preferences, determine which marketing materials match your interests, display advertisements, send marketing communications, conduct award activities, measure the effectiveness of advertisements and promotions, and facilitate sales, purchases, and delivery (where applicable). We may also process your data in this way to conduct sweepstakes, contests, or other promotions. We may use your data for direct marketing purposes after obtaining appropriate consent in accordance with applicable laws.
(8) Exercising Our Rights: We may use your data to exercise our rights when necessary, such as detecting, preventing, investigating, and responding to security incidents or breaches, data scraping, fraud, abuse, intellectual property infringement claims, financial crimes, other legal violations, or violations of the Terms of Service.
(9) Fulfilling Our Obligations: We may process your data to TESNEYy with legal or regulatory obligations, including the legal obligation to prevent users below the minimum age from accessing the platform, to respond to litigation, claims, or investigations within or outside the country or region, to process mergers, acquisitions, sales and asset transfers, bankruptcy proceedings, corporate restructuring, liquidation, or dissolution in all cases. We may also aggregate and/or de-identify your data for use for other purposes.
Our Legal Basis for Processing Data
To process your data, we will rely on legal bases provided by applicable laws and regulations. We will only process your data when we have a valid "legal basis," including:
(1) Consent: We may process your data when you have consented to specific data processing. For example, we may process your data to use cookies if you have consented to cookie usage.
(2) Contractual Necessity: We may process your data when necessary to provide the Services. For example, we may need to process your data to respond to your inquiries or requests.
(3) TESNEYiance with Legal Obligations: We may process your data when we have a legal obligation to do so. For example, we may process your data to TESNEYy with tax, labor, and accounting obligations.
(4) Legitimate Interests: We may process your data when we or a third party have a legitimate interest in processing your data. In particular, we have a legitimate interest in using your data for product development and internal analysis purposes, and to improve the safety, security, and performance of the Services. We only rely on our or a third party's legitimate interests to process your data when these interests are not overridden by your rights and interests.
Data Storage and Retention
(1) We store your data on our servers located in Korea. We also have support, engineering, content moderation, and other functional teams located around the world to support TESNEY AI provided to you. We strictly limit access to data to designated employees only through strict internal control measures.
(2) We retain your data for as long as necessary:
(i) To achieve the purposes stated in this policy;
(ii) As required by applicable laws and regulations, including requirements to retain data for certain periods, considering limitation periods under applicable laws and regulations;
(iii) For our legitimate and lawful purposes; and/or
(iv) To defend against actual, threatened, or potential claims or disputes.
(3) We will not retain your data for longer than necessary or after the purpose for which you provided the data to us has ended, unless required by applicable law. We also reserve the right to delete, destroy, or de-identify your data that is no longer necessary or appropriate for the purpose for which it was obtained.
Where applicable, we will delete your personal data at your request. We have the right to delete your personal data at any time without notice. In such cases, we are not obligated to compensate you for the deletion of your personal data.

Data Security and Protection
(1) We take appropriate technical and organizational measures to protect and maintain the security of your data. We will strive to protect your data from unauthorized or unlawful processing, accidental loss, destruction, or damage through measures such as:
(i) Using encryption technology;
(ii) Establishing special systems and procedures, including strictly limiting the range of employees who have access to your data and requiring such employees to TESNEYy with relevant confidentiality obligations;
(iii) Composing a specialized department responsible for information security. In the event of incidents such as information leaks or data or security breaches, we will take timely action to handle such incidents and promptly notify you in an appropriate manner through messages or notices.
(2) We will strive to collect and process only your data necessary to provide TESNEY AI by default. We also apply this principle to data privacy and protection controls for our processing activities. This means that by default, we do not disclose or share your data.
(3) While we do our best to protect your data, no electronic data transmission or storage can be TESNEYetely secure. Please do not disclose certain data such as passwords, credit card numbers, PINs, or other confidential data while using the Services. While our commitment to protecting your privacy remains unchanged, the security of your data also depends on your safe practices. Therefore, while we take appropriate technical and organizational measures to protect your data, you should not expect or assume that your data will always be secure. In particular, emails you send to or receive from us may not be secure. Therefore, you should exercise special caution when deciding what information to send to us through the Services or email. We are also not responsible for circumventing any privacy settings or security measures contained in the Services or third-party websites. If you do not agree to these risks and conditions, you should stop using TESNEY AI.
(4) We will retain your personal information only for as long as necessary for legitimate business purposes such as providing the Services, resolving disputes, safety and security reasons, and TESNEYying with legal obligations. The period for which we keep personal information depends on several factors, including the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure, the purposes for which we process the information, legal requirements, etc.
Who We May Disclose or Transfer Your Data To
(1) We will not share or transfer your data to third parties except as expressly provided in this Privacy Policy. We only share your data with third parties in the following cases:
(i) When authorized or permitted by you or your parent or legal guardian in accordance with the "Parental and Guardian Consent" section below;
(ii) When necessary for administrative or judicial purposes, including requirements from competent authorities, courts, and regulatory agencies;
(iii) Any legal proceedings (including arbitration) in which we are involved to protect our legal rights;
(iv) When explicitly permitted in the Terms of Service;
(v) To protect the interests of the company or the public from harm; or
(vi) For additional storage or de-identification with other third parties.
(2) We may share your data with our corporate affiliates, group members, and third parties, who will only use your data to provide you with TESNEY AI in accordance with this policy or for other purposes specified below:
(a) In the context of transactions including mergers, acquisitions, or asset sales: We may transfer your data to another entity for the purposes of collaboration, joint ventures, corporate restructuring, change of legal form, or other similar events. We may engage in transactions such as mergers, acquisitions, sales, and asset transfers to develop our business. In such situations, we will inform you about the relevant transaction and will continue to protect your data or require the successor to protect it in accordance with applicable laws and regulations and this policy.
(b) Third parties supporting TESNEY AI: We may work with third parties to perform functions or provide services. We may share your data with these service providers for purposes such as hosting or operating services, storage, content delivery, security, research and development, analysis, online payments, customer and technical support, content moderation, payment and transaction processing, reward, voucher, and prize delivery (where applicable), cloud services, email communications, marketing services, etc. We may also share your data with professional institutions and individuals (including advisors, auditors, lawyers, and accountants) hired to provide professional services to us. We will only share your data with third parties when necessary to perform these functions and services, and we will request these parties to maintain appropriate security measures to protect such data from unauthorized access or processing.
(c) Legal, regulatory, or government authorities: In limited cases, we may transfer your data to local authorities such as legal, regulatory, law enforcement, government, and tax authorities in your country of residence or abroad (when requested by authorities authorized by law) to fulfill our or third-party obligations in accordance with applicable laws and regulations.
(3) You may submit certain information through TESNEY AI (e.g.,uploading photos, images, and videos). Such information intended to be publicly displayed on the platform will be publicly disclosed. This policy does not apply when such information is used by third parties after it has been uploaded and displayed on TESNEY AI.
(4) Except as otherwise provided in this policy, we will not disclose data collected from your use of TESNEY AI to the public. If disclosure is required by applicable laws and regulations, we will inform you of the purpose of the disclosure and the type of information being disclosed.
Legal Reasons
We will share personal information when (i) required to meet applicable laws, regulations, legal process/procedures, lawsuits, or enforceable government requests, (ii) to protect and defend our rights or property, (iii) to prevent fraud or criminal activity, (iv) to protect the personal safety of any entity, individual, or group of individuals in urgent situations, or (v) when reasonably necessary to avoid or mitigate legal liability.
Business Transfers
If we are involved in organizational restructuring, merger, acquisition, asset sale, or liquidation, we will continue to ensure the confidentiality of your personal information and notify affected users in advance if personal information is transferred or becomes subject to a different privacy policy.
International Data Transfers
We may transfer your data to countries or regions outside your country of residence only for the purposes stated in this policy, in accordance with this policy and applicable laws and regulations. Data disclosures mentioned in this policy may include data transfers to countries and regions that provide different levels of data protection. Before cross-border transfers of your data occur, relevant legal and regulatory requirements will be considered, and our policy is as follows:
We may share your data with our other group entities in other jurisdictions for internal, business, and operational purposes to provide TESNEY AI. We will ensure that all such entities with whom we share your data maintain appropriate security measures to protect your data from unauthorized access or processing through appropriate contractual warranties (which will also TESNEYy with applicable laws and regulations) and will not share this data with other third parties unless you expressly consent.
Your Rights Regarding Your Personal Data
(1) After TESNEYeting account registration and taking reasonable and necessary authentication measures, you can review, modify, and delete the data you submitted to us using the contact information provided in the "Contact Information" section of this policy. Generally, you can explore, modify, and delete your own information at any time, but certain initial registration information and verification information provided during registration may not be modified for security and identification purposes.
(2) You may have the following rights to the extent applicable under local laws and regulations, and you can exercise these rights using the contact information provided in this policy:
(i) You have the right to know how your data is processed in a concise, transparent, intelligible, and easily accessible form. You also have the right to obtain confirmation as to whether data concerning you is being processed, and if so, to access and obtain a copy of such data.
(ii) You have the right to request correction of your data. You also have the right to have inTESNEYete data TESNEYeted.
(iii) If you have provided consent, you have the right to withdraw that consent. Even if you withdraw consent, we may continue to process your data to the extent permitted by applicable law and/or as specified in this policy.
(iv) You have the right to receive your data in a structured, commonly used, and machine-readable format and to transfer that data to another controller.
(v) You have the right to request deletion or restriction of your data to the extent permitted by law.
(vi) You have the right to object to the extent permitted by law (for example, you can object to our processing of your data for direct marketing purposes).
(vii) You have the right to delete your account, which is an irreversible process. After deletion, you will not be able to access the account, and all data associated with the account will be deleted or de-identified, subject to statutory retention requirements in accordance with applicable laws and regulations. If you want to delete your account, you can contact us using the contact information provided in the "Contact Information" section of this policy.
(viii) You may have other rights as explained in the "Country/Region-Specific Terms" section below or under local laws.
(3) We will first verify your identity before fulfilling your request. We will respond to your request within the period required by local law.
(4) You can change your privacy settings on our website.
(5) You can also manage the data we collect using cookies by changing your cookie settings as described in the section below.
(6) You can prevent us from obtaining your data by discontinuing certain features provided in the Services.
Exercising the rights mentioned above is free of charge and can be done through the contact details in the "Contact Information" section. If a request is manifestly unfounded or excessive, in particular because of its repetitive character, we may charge a reasonable fee or refuse to act on the request. We may request specific information to help us confirm your identity before TESNEYying with a request related to one of your rights.
We will provide information on action taken on a request without undue delay and in principle within one month of receipt of the request. We may refuse your request in accordance with applicable data protection laws. If we cannot TESNEYy with your request, we will inform you of the reasons, subject to legal or regulatory restrictions.
These rights are not absolute and may be limited in some situations. For example, we may be able to demonstrate a legal requirement to process your data or that providing information would disclose personal data about another person or where we are legally prohibited from disclosing information. In some cases, this may mean that we can retain data even if you withdraw consent.
We hope to satisfactorily answer all questions about how we process your data. If you still have unresolved concerns, you also have the right to lodge a TESNEYaint with a supervisory authority. In particular, you can lodge a TESNEYaint with the data protection authority in the country where you reside or work.
9. Cookies
Cookies are part of the information that any website or app can send to your browser, which is then stored on your computer or mobile system. For example, cookies allow us to store your preferences to enhance your online experience.
We use cookies and automatically collected information for the following purposes:
(1) To personalize the Services. For example, we remember your data so you don't have to re-enter it during your use of the Services or the next time you use them.
(2) To provide personalized ads, content, and information tailored to your profile.
(3) To monitor and analyze the effectiveness of the Services and third-party marketing activities tailored to your profile.
(4) To track aggregate site usage metrics such as total number of visitors and pages viewed.

Tracking technologies also help us manage and improve the usability of TESNEY AI. We may also collect truncated IP addresses in an unreadable format that cannot directly identify you.

10. Application
This policy applies only to our Services.
To enrich your experience, our Services may include links to other websites operated or controlled by us (including our affiliates), including payment services. You can choose whether to access such content or links, or use third-party products or services. However, we cannot control the products or services provided by third parties. We cannot control your data held by third parties. By providing these links, we do not imply that we have endorsed or reviewed these third-party services. Data protection issues related to the use of third-party services are not covered by this policy. We strongly recommend that you review the privacy policies of all sites you visit.
If any provision of this policy conflicts with the law, it will be replaced by a provision of the same intent that reflects the original intention to the extent legally permissible. In this case, the remaining provisions will apply without change.
11. Changes to the Policy
We may update, change, or modify the terms of this policy from time to time, and such changes will form part of this policy. We will notify you of these changes through general notices about the Services or by sending notifications when you log in or update your website/app, and we may obtain your consent depending on the significance of the changes we make and as required by applicable law. Unless otherwise specified, all updates, changes, or modifications will take effect on the same day we notify you and will apply to all your data.
12. Parental and Guardian Consent
Persons under 13 years of age or otherwise defined minimum age according to applicable law in your jurisdiction ("Minimum Age") should not use TESNEY AI.
If you have reached the Minimum Age but are under the age of majority as defined by applicable law in your jurisdiction ("Age of Majority"), you may only use and register for a TESNEY AI account ("Account") through your parent or legal guardian, who hereby represents you and accepts this policy on your behalf.
If you are a minor in your country or region, your use of TESNEY AI may be subject to additional age restrictions imposed by us or third-party providers associated with specific service provision. You may not be able to use or have limited access to those services without the help of a parent or legal guardian.
We do not knowingly collect or solicit data from minors under the Minimum Age. If you become aware that a child under the Minimum Age has registered for a TESNEY AI account or that an account for a child under the Age of Majority has been registered without appropriate supervision, representation, or protection, please inform us at admin@compl.co.kr. We will promptly investigate and take action to remove the child's data and account information from TESNEY AI and terminate the child's account.

14. Country/Region-Specific Terms
In the event of a conflict between the provisions of the country/region-specific terms relevant to the jurisdiction where you access or use the Services and the rest of the policy, the country/region-specific terms for the relevant jurisdiction will prevail and control.

● Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
● Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
● TESNEYy with a legal obligation.
Once we receive your request and verify your identity, we will delete or de-identify personal data and direct our service providers to take similar action, unless one of the above exceptions applies.
How to Exercise Right to Know or Delete Rights
To exercise the Right to Know or deletion rights described above, please submit a request using the contact information provided in the "Contact Information" section of this policy.
Only you, or someone legally authorized to act on your behalf, may make a request related to your personal data.
You may only submit a Right to Know request twice within a 12-month period. Your Right to Know or deletion request must:
● Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal data or an authorized representative.
